ACCEPTANCE OF TERMS

Your use of our site tells us you have read and agreed to these Terms of Service and our Privacy Policy that may be updated periodically without prior notice. Bignepal.com reserves the right to deny access or account revocation to the site to any person who violates these Terms of Service. DESCRIPTION OF SERVICE

Bignepal is a web-based service that allows its users to create and update online services. Once registered with Bignepal, each user receives his or her own control panel to post text, data, messages, videos or information. Bignepal provides users with access to a rich collection of resources, including various communications tools, forums, chat, Dating, videos, photos, search services and personalized content . You also understand and agree that the Service may include advertisements and that these advertisements are necessary for Bignepal to provide the Service. You also understand and agree that the Service may include certain communications from Bignepal, such as service announcements, administrative messages and the Bignepal Newsletter, and that these communications are considered part of Bignepal membership. Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new Bignepal properties, shall be subject to the Terms of service.

ACCOUNT REGISTRATION AND REQUIREMENTS

You must establish an account with Bignepal.com (“Your Account") to use the Service, except for those portions of the Websites to which Bignepal.com allows access without registration. To access certain features of the Site, we may ask you to provide certain demographic information including your gender, year of birth, zip code and country. In addition, if you elect to sign-up for a particular feature of the Site, such as Fulbari (community network), Forums (message board), Drishya (upload and share videos), blogs, Gallery (photos), chatting and dating. you may also be asked to register with us on the form provided and such registration may require you to provide personally identifiable information such as your name and email address. You agree to provide true, accurate, current and complete information about yourself as prompted by the registration form ("Sign Up Process ") and maintain and promptly update (“Your Account") to keep it true, accurate, current and complete. Bignepal.com reserves all rights to vigorously pursue legal action against all persons who misrepresent personal information or are otherwise untruthful about their identity, and to suspend or cancel Accounts registered with inaccurate or incomplete information. Notwithstanding the foregoing, you acknowledge that Bignepal.com cannot guarantee the accuracy of any information submitted by any user of the Service, nor any identity information about any user. Our use of any personally identifiable information you provide to us as part of the registration process is governed by the terms of our Privacy Policy.

MEMBER ACCOUNT, PASSWORD AND SECURITY

To use certain features of the Site, you will need a username and password, which you will receive through the Site’s registration process. You are responsible for maintaining the confidentiality of the password and account, and are responsible for all activities (whether by you or by others) that occur under your password or account. You agree to notify us immediately of any unauthorized use of your password or account or any other breach of security, and to ensure that you exit from your account at the end of each session. We cannot and will not be liable for any loss or damage arising from your failure to protect your password or account information. Account registrations are limited per unique person. Transfers of accounts are generally not permitted. However, You may cancel your account at any time by contacting us.

MEMBER CONDUCT

You agree to abide by certain rules of conduct, including the Community Standards and other rules prohibiting illegal and other practices that Bignepal.com deems harmful. You understand that all information, data, text, software, music, photographs, graphics, video, messages, tags, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not Bignepal are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. Bignepal does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. Take any actions or upload, post, e-mail or otherwise transmit Content that contains any viruses, Trojan horses, worms, spy ware, time bombs, cancel bots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information;
Take any action or upload, post, email or otherwise transmit any Content that would violate any right or duty under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
Upload, post, email or otherwise transmit any unsolicited or unauthorized advertising, or promotional materials, that are in the nature of "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation that we considers in our sole discretion to be of such nature;
Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
Attempt to gain access to any other user's Account or password;
Stalk, abuse or attempt to abuse, or otherwise harass another user.

Any violation by you of the terms of the foregoing sentence may result in immediate and permanent suspension or cancellation of your Account. You agree that Bignepal.com may take whatever steps it deems necessary to abridge, or prevent behaviour of any sort on the Service in its sole discretion, without notice to you.

USE OF DIRECTORIES

The information contained in any company directories that may be provided on the Site is provided for business lookup purposes and is not to be used for marketing or telemarketing applications. This information may not be copied or redistributed and is provided “AS IS” without warranty of any kind. In no event will our suppliers or we be liable in any way with regard to such information.

INTERACTIVE FEATURES

This Site may include a variety of features, such as Forums (message board), Fulbari (community network), Drishya (upload and share videos), blogs, chat rooms, datings, Gallery (photos) and email services, which allow feedback to us and real-time interaction between users, and other features, such as personalized home pages and email services, which allow users to communicate with others. Responsibility for what is posted on Forums, chat rooms, and other public posting areas on the Site, or sent via any email services on the Site, lies with each user – you alone are responsible for the material you post or send. We do not control the messages, information, files or video that you or others may provide through the Site. It is a condition of your use of the Site that you do not:

Restrict or inhibit any other user from using and enjoying the Service.

Bignepal reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service with or without notice. You agree that Bignepal shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

TERMINATION

We may cancel or terminate your right to use the Site or any part of the Site at any time without notice. In the event of cancellation or termination, you are no longer authorized to access the part of the Site affected by such cancellation or termination. You further acknowledge and agree that Bignepal shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

Without the permission of Bignepal.com you cannot use and display logos or trade marks in any manner. It is our responsibility to notice alleged copyright infringement and to terminate the account of repeat infringers.

GENERAL PROVISIONS

This agreement constitutes the entire agreement between us and you with respect to the subject matter contained in this agreement and supersede all previous and contemporaneous agreements, proposals and communications, written oral. You also may be subject to additional terms and conditions that may apply when you use the products or services of a third party that are provided through the Site. In the event of any conflict between any such third-party terms and conditions and these Terms of Service, these Terms of Service shall govern. This agreement shall be governed by and construed in accordance with the country’s laws without giving effect to any principles of conflicts of law. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
